In a move that everyone could have seen coming, juggernaut game maker Nintendo has officially filed a lawsuit against producer Ghastly for infringing on their trademark for their popular Ghost-type Pokémon, spelled “Gastly.”
Despite the obvious difference in spelling, Nintendo asserts that Ghastly is causing confusion with his branding and creating ambiguity between the two entities.
Doug Bowser, Senior Vice President of Sales and Marketing at Nintendo, states, “Gastly is one of our most well-known IPs. Despite the obvious orthographic difference, we believe that ‘Ghastly’ is infringing on our trademark via numerous references in his branding and public image.” 
When we reached out to Ghastly for comment, his response was, “I don’t know about any of that. I’m more of a friendly ghost type anyway.”
The lawsuit is expected to move forward later this spring.
